Article 1: GENERAL PROVISIONS

These general terms and conditions constitute a distance sales contract, defining the rights and obligations of the shop Fatbike Factory and the Client within the framework of the sale of products listed on the website www.fatbike-factory.com.

These terms are concluded between the online store Fatbike Factory, hereinafter referred to as “Fatbike Factory,” and any person wishing to make a purchase, hereinafter referred to as the “Client,” via the website www.fatbike-factory.com hereinafter referred to as the “Site.”

Clients are consumers, defined as natural persons acting for private purposes or for purposes that do not fall within the scope of a commercial, industrial, craft, or liberal professional activity, wishing to make a purchase on the Site.

The Client’s validation of an order implies acceptance of these terms.

These general terms and conditions of sale may be modified at any time and without notice by Fatbike Factory, with such modifications applying to all orders placed after their publication. Fatbike Factory may occasionally amend specific provisions of its general terms and conditions of sale. Therefore, Clients are advised to reread them before each order validation.

Article 2: THE SITE - PRODUCTS - AVAILABILITY

All content on the Site (illustrations, texts, labels, trademarks, images, videos) is the property of Fatbike Factory. Any full or partial reproduction of the Site is prohibited, unless expressly authorized in advance by Fatbike Factory. The store Fatbike Factory does not allow the creation of hyperlinks without its prior consent.

The products offered for sale by Fatbike Factory are presented and detailed so that any consumer can know the essential characteristics of the products they wish to purchase, particularly through technical descriptions and photographs illustrating the products.

Consequently, Fatbike Factory cannot be held liable for any errors that do not affect the essential characteristics of the product.

The photographs, illustrations, and texts on the Site are not contractual.

The products are new. They are offered for sale subject to availability and supply capacity from Fatbike Factory’s suppliers.

Product availability will be definitively confirmed upon order shipment confirmation, which will be sent to the Client by email.

If one of the products ordered is not available at the time of order preparation, Fatbike Factory undertakes to contact the Client by email as soon as possible to offer a replacement product, or to cancel and refund the missing product at the Client’s request.

The refund of the unavailable product will be made no later than fifteen (15) days after receipt of the amounts paid by the Client. The refund will be made to the Client’s PayPal account or bank account. The cancellation and refund of the unavailable product will not affect the rest of the order, which will remain firm and final.

Article 3: ORDERS

The Client shall place orders in accordance with the instructions given on the Site. They undertake to complete their registration and order form, ensuring that the information provided is complete and accurate. In any case, the Client is responsible for the information entered on their registration form and during the order process. In case of error, Fatbike Factory shall not be held responsible for delivery issues or delays caused by incorrect details (wrong address, wrong name, etc.).

The steps to complete a purchase on the Site are as follows:

  • The Client selects their products
  • The Client chooses the product quantity and clicks on the “Add to Cart” button
  • The Client then clicks on the “My Cart” tab and confirms the order by clicking on the “Confirm Order” tab
  • If the Client is registered, they log in by entering their username and password
  • If the Client is not yet registered, they must create an account
  • The Client chooses their delivery and billing address
  • The Client selects the delivery method and acknowledges the potential cost. They accept the general terms and conditions of sale
  • The Client clicks on the “Next” tab
  • The Client chooses the payment method, completes payment, and confirms the order

Once the order is validated, the Client may print a summary of their order, which will also be sent by email. This document must be kept, as it constitutes proof of the Client’s order and the binding contract between the parties.

In any case, Fatbike Factory reserves the right not to comply with any Client request that would be excessive or contrary to common law and its general terms, or where the Client has not fulfilled their obligations toward Fatbike Factory.

Article 4: PRICES AND PAYMENT

The sales prices of the products indicated on the Site are in euros, inclusive of all taxes, excluding delivery costs.

The total amount is in any case indicated at the end of the online order, before validation. The price invoiced to the Client is the price specified in the order confirmation, including the total price of the products plus any applicable delivery costs.

Delivery costs are determined based on the order amount.

Fatbike Factory reserves the right to change its prices at any time. However, no change may apply to orders already placed. The applicable price is the one shown on the Site at the time of the order.

Orders are payable in euros, in full, and upfront. At no time can the sums paid be considered as deposits or down payments.

Payment can be made either by:

  • Credit card
  • PayPal

The order amount will be debited at the time of order confirmation.

Once payment is validated, the Client will receive confirmation of the order by email, along with the invoice.

Fatbike Factory retains full ownership of the products sold until full payment of all amounts due for the Client’s order.

Article 5: SHIPPING - DELIVERY - RECEIPT - USE OF PRODUCTS

Shipping is made to the address provided by the Client at the time of the order. Shipping occurs within 2 to 3 business days.

Delivery is deemed complete by Fatbike Factory once the ordered products are handed over by the carrier to the Client. Product risks are immediately transferred to the Client.

For deliveries within Europe, after shipping, Fatbike Factory provides the Client with a tracking number to follow their parcel.

It is the Client’s responsibility to check the condition of the packaging, the products, and the number of items received. This verification is deemed complete from the first day of receipt at the Client’s address.

In case of disputes, product damage during transport, shortages, or delays, the Client must promptly contact Fatbike Factory customer service.

Any late complaint may prevent its consideration (maximum deadline of 14 days from receipt).

In any case, Fatbike Factory shall not be held liable for any delay or failure of delivery caused by force majeure or by the Client’s fault.

The delivery times indicated by carriers are for reference only. Fatbike Factory cannot be held responsible for delays beyond its control.

Article 6: RETURNS, LIABILITY, AND WARRANTIES

Fatbike Factory accepts returns within a 14-day withdrawal period. Products must be returned in perfect condition, in their original packaging. Depending on the case, a replacement or refund will be offered after verification.

Return costs and risks are borne by the Client. Items purchased using vouchers or discounts will be refunded in the same form.

Article 7: FORCE MAJEURE

In the event of force majeure preventing contract execution, the contract will be suspended. If the event lasts more than 15 days, the contract will be terminated, and any sums received will be refunded.

Article 8: CLIENT OBLIGATIONS

The Client undertakes to provide accurate information to ensure proper order execution. Fatbike Factory shall not be held responsible for errors or delays caused by incorrect information.

Article 9: DATA PROTECTION

Fatbike Factory uses Clients’ personal data for order management. In accordance with the law, the Client has the right to access, modify, and delete their data. To exercise this right, please contact Fatbike Factory using the provided details.

Article 10: DISPUTE RESOLUTION

In case of a dispute, the Client may resort to conventional mediation or any other alternative dispute resolution method.
